Scope

The service

AxForge provides European AI infrastructure: (a) a serverless, OpenAI-compatible API to hosted AI models; (b) dedicated GPU rental, meaning a dedicated NVIDIA GB10 (DGX Spark) machine with full SSH access, rented On-Demand from now, or Scheduled in whole hours reserved ahead, for as long as a year; and (c) managed GPU deployments, scoped, deployed and operated by AxForge under a separate order. Model availability, context limits and prices are stated on the site or agreed per order.

These terms apply to every account. The Legal Notice lists the contact routes.

Accounts and API keys

You create an account in the AxForge Console; your API key is issued there. Keys are personal to the customer: do not share, publish or resell them. You are responsible for everything sent with your keys, for the workloads run on machines rented under your account, and for your account credentials.

Your use

You may not use the service for unlawful content or activity, to violate third-party rights, or to probe or disrupt the infrastructure. Use is governed by the acceptable-use policy, which forms part of these terms. Posting on the AxForge forum is also governed by the community guidelines, which form part of these terms too.

Serverless API

Usage, balance and included tokens

Metering and balance

Everything is paid from one prepaid balance: serverless usage, chat in the console and GPU rentals. Serverless usage is metered per token at the published list prices and is drawn from the balance. Every new account includes 3M free serverless tokens every 30 days. The included allowance is a launch offer and may be changed with notice on the pricing page. When the balance is exhausted, further requests are declined until it is topped up.

Top-ups

You top up the balance in the console, by card through Stripe Checkout, in one of five amounts: €10, €25, €50, €100 or €250. The amount is what reaches your balance. Top-ups are non-refundable except where the law requires otherwise.

Top-up bonus

A top-up of €25 or more adds bonus credit to your balance: €25 → +€10 · €50 → +€20 · €100 → +€40 · €250 → +€80. The console and the pricing page show the bonus in force before you pay, and the bonus is fixed when the top-up is paid. Bonus credit pays for everything the balance pays for. It is used after your paid balance, and it does not expire. It has no cash value and cannot be refunded, withdrawn or transferred. If a top-up is refunded where the law requires it, the bonus that top-up added is removed to the extent it has not been used. The console shows your paid balance and your bonus separately, and which of the two paid for each use.

Model outputs

Outputs are machine-generated and not guaranteed to be factually correct; keep a human in the loop for consequential decisions. Models change over time under the model-change policy. The served model identity is returned on every API response.

Booking, payment, start and end

Rental periods and reservations

A rental is either On-Demand (started now when capacity is available, charged by the hour from your balance while it runs, for at most 48 hours) or Scheduled (whole hours you reserve in the console calendar, by the hour, by the day or by the week, from any start day, for as long as a year). Prices are on the pricing page. Capacity is subject to availability; the console shows what is free.

Longer bookings, lower rates

A Scheduled booking is priced by the hours it books, and the rate it earns applies to every hour of it: 168 hours (7 days) or more at the week rate, 672 hours (28 days) or more at the month rate, and 8,760 hours (365 days) or more at the year rate. Fewer hours are at the scheduled hourly rate. The rate a booking got is recorded on it and shown with it.

Payment

Rentals are paid from your balance only: a card pays for top-ups, never for a rental directly. A Scheduled booking is paid in full from the balance when you reserve it, and needs a balance that covers it. An On-Demand session is charged by the hour while it runs, and ends when the balance runs out. A confirmed Scheduled booking can be cancelled up to 24 hours before it starts, and its amount returns to your balance; after that it is not refunded, including for unused hours. Prices are in EUR.

Start and end of a rental

The rental starts when the machine is handed over to you (SSH access to your dedicated machine with the key you added in the console) and ends at the end of the booked period, or earlier if you end it in the console. When the rental ends, whether by time or by your action, the machine and all data on it are deleted irreversibly. Export anything you need before the rental ends. Ending a rental early does not refund the remaining booked period.

Your environment

During the rental you operate the machine: your software, your data and the security of what you run on it. AxForge provides the hardware, network and base image, keeps the machine dedicated to you for the rental period, and does not access its contents except as necessary to provide the service, to address security or abuse, or as required by law.

Managed GPU

Managed deployments

Managed deployments (dedicated AI infrastructure configured and operated by AxForge) are scoped and quoted per deployment. Each deployment is governed by its order together with these terms; where the order and these terms conflict, the order prevails for that deployment.

Data

Your data stays yours

Prompts and completions are not stored and never train models. See the privacy policy. You retain all rights to your inputs and outputs, and to everything you place on a rented machine.

The customer owns its inputs and outputs. AxForge claims no rights in customer content beyond what is needed to serve the request or run the rented machine.

Where processing happens

All processing happens inside the EEA, on hardware AxForge owns, as a contractual commitment, not a configuration default: eu-se-1 · Stockholm for serverless inference and RTX 3060 rentals, eu-es-1 · Málaga for dedicated DGX Spark workloads. There is no failover outside the EEA: if all EEA capacity is unavailable, requests queue or fail; they are never routed outside the EEA.

Commercial

Availability, suspension, liability

Availability

The service is provided as-is; contractual uptime, where offered, is defined in the applicable order or SLA and not implied by this page. We may suspend access for abuse or non-payment.

Suspension and termination

We may suspend access for violation of these terms or the acceptable-use policy; appeals go to hello@axforge.ai. Either party may terminate as set out in the applicable agreement. On termination, API keys stop working, active rentals end and their machines are deleted, and deletion of remaining data follows the section below.

Liability

To the extent permitted by law, liability is limited to the fees paid in the preceding three months and excludes indirect damages, including loss of data on a rented machine that was not exported before the rental ended.

Agreements

Confidentiality, deletion, DPA, law

Confidentiality

Each party keeps the other's non-public information confidential and uses it only to perform the agreement. Our technical and organisational measures are summarised in the Data Processing Agreement; the full TOMs annex is available under NDA.

Deletion at termination

Prompts and completions are never stored, so there is nothing to delete from inference. Rented machines are deleted with all their data when the rental ends. Account data and retained metadata are deleted per the retention table (account profile: account lifetime plus 90 days), except records accounting law requires us to keep.

Data processing agreement

The Data Processing Agreement under Article 28 GDPR applies to personal data AxForge processes on your behalf and is incorporated into these terms by reference; where the two conflict, the DPA prevails for personal-data processing. A countersigned copy is available on request.

Changes and law

We may update these terms with notice on this page.

Service changes follow the same rule: dated notice on the affected page. Model additions, replacements and retirements follow the model-change policy.
